Another Brickman and Gwin Summary Judgment Granted

Mindy Brickman and Mac Gwin recently secured a Summary Judgment for a major metropolitan airport in a personal injury lawsuit at Civil District Court in New Orleans.  This was a slip and fall case where the plaintiff slipped on a concourse floor spill made by another passenger.  Despite plaintiff’s opposing arguments that the airport should have real-time monitoring of all surveillance cameras to ensure immediate detection of any floor spill, the Court disagreed.  It found that the surveillance footage showed the spill had only existed for nine minutes before the accident—insufficient time, under La. R.S. 9:2800, to charge the airport with actual or constructive notice and an opportunity to clean it up.  In terms of the team effort to secure Summary Judgment for this valued client, Mindy Brickman handled oral argument and Mac Gwin handled the briefing.
